Barzo App End User Terms and Conditions

These Barzo App End User Terms and Conditions (“Terms”) constitute a binding agreement between you (“End User,” “you,” or “your”) and Barzo, Inc., a Delaware corporation (“Barzo,” “we,” or “us”). These Terms govern your use of the Barzo mobile application (“App”) and related services, including all associated documentation.

By clicking "Accept," or by downloading, installing, or using the App, you (a) confirm that you have read and understand these Terms; (b) represent that you are 18 years or older; and (c) agree to these Terms. If you do not agree, do not download, install, or use the App.

1. License Grant

Barzo grants you a limited, non-exclusive, non-sublicensable, and non-transferable license to download, install, and use the App for personal, non-commercial purposes on a device you own or control. Certain components of the App may be governed by open-source licenses, which take precedence where applicable.

2. User Account

To access the App, you must create an account. You are responsible for maintaining the security of your account and all activities that occur under it. You agree to:

  • Use a secure password and safeguard your login credentials.
  • Comply with all applicable laws while using the App.
  • Respect other users in your interactions.

Barzo reserves the right to suspend or terminate accounts at its sole discretion.

3. Content and User Contributions

The App allows users to post, comment, and share content, including media (“User Contributions”). You are solely responsible for your User Contributions and must ensure they:

  • Do not contain abusive, defamatory, obscene, NSFW, or unlawful content.
  • Do not infringe on the rights of others, including intellectual property rights.

Barzo reserves the right to moderate, review, and remove User Contributions that violate these Terms or published guidelines.

4. Communications and Privacy

By using the App, you consent to receiving communications from Barzo and other users through messaging, email, text messages, and push notifications. You can opt out of certain notifications via App settings.

Barzo collects and uses information as outlined in its Privacy Policy. By using the App, you consent to these practices.

5. License Restrictions

You agree not to:

  • Copy, modify, or create derivative works of the App.
  • Reverse-engineer or attempt to access the App’s source code.
  • Use automated tools (e.g., bots, spiders) to interact with the App.
  • Circumvent security measures or use the App in a manner that overloads or disrupts its functionality.

6. Alcohol Transactions

If purchasing alcohol via the App, you must:

  • Be of legal drinking age and provide valid government-issued identification at participating venues.
  • Comply with all applicable laws.

Barzo does not process alcohol transactions directly; they are processed by participating venues.

7. Geographic Restrictions

The App and its services are intended for use within the United States. Access outside the U.S. may be restricted or subject to local laws, which you are responsible for complying with.

8. Updates and Support

Barzo may provide updates or changes to the App, including bug fixes, security patches, and new features. Failure to install updates may result in reduced functionality. Support services may be available at Barzo’s discretion.

9. Fees and Transactions

The App may require fees, which are subject to change. Transactions processed through the App use third-party services, such as Plaid, Inc. These services are subject to their own terms and conditions.

10. Feedback

Any feedback you provide becomes the property of Barzo. You grant Barzo an irrevocable, royalty-free license to use, modify, and distribute your feedback for any purpose.

11. Third-Party Materials

The App may display or link to third-party content. Barzo is not responsible for the accuracy, legality, or reliability of such content. Accessing third-party materials is at your own risk.

12. Termination

These Terms remain in effect until terminated by either party. You may terminate by deleting the App from your device. Barzo may terminate your access without notice if you violate these Terms.

13. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind. Barzo disclaims all implied warranties, including merchantability and fitness for a particular purpose.

14. Limitation of Liability

To the maximum extent permitted by law, Barzo is not liable for:

  • Indirect, incidental, or consequential damages arising from your use of the App.
  • Damages exceeding the fees paid by you for the App, if any.

15. Indemnification

You agree to indemnify Barzo against all losses, liabilities, or claims arising from:

  • Your use or misuse of the App.
  • Your breach of these Terms.
  • Your violation of applicable laws.

16. Governing Law and Disputes

These Terms are governed by the laws of Florida. Any disputes must be resolved exclusively in courts located in Tampa, Florida. Claims must be filed within one year of the cause of action.

17. Changes to Terms

Barzo may revise these Terms. Significant changes will be communicated via the App or email. Continued use of the App constitutes acceptance of revised Terms.

18. Copyright and Trademark Policy
